A MOTHER of two will today mount a legal challenge to her local NHS trust's refusal to give her the breast cancer drug Herceptin.
Ann Marie Rogers, 53, has been denied the drug, which is said to halve the chances of the aggressive HER-2 form of breast cancer, by Swindon Primary Care Trust.
She has borrowed Pounds 5,000 for treatment so far but says she cannot afford to fund further courses.
At an earlier hearing a judge in the High Court in London ruled that her case merited a full hearing and was of general and public importance.
Mr Justice Charles ordered that the PCT should continue her treatment with the drug pending the full hearing. The case over the rights to receive Herceptin is the first to reach the courts.
Last year nurse Barbara Clarke, 49, from Somerset, and Elaine Barber, 41, from Stoke, threatened to take their health trusts to court but both agreed to supply Herceptin.
Ms Rogers said in a statement: "I am angry with my PCT for refusing to fund the health treatment I need. I did not want to fight to get this treatment but I will continue to do so."
